Terms and conditions of sale
SUBJECT
This document constitutes the general terms and conditions of sale (hereinafter referred to as the "GTC") applicable between the user of the site (hereinafter referred to as "You" or "the User") and the company æquidem, a simplified joint-stock company with its registered office at 5 rue de la Paix 92270 Bois-Colombes, registered under number 942611534 RCS de Nanterre (hereinafter referred to as "æquidem" or the "Company").
It governs the contractual relationship between æquidem and you, particularly concerning any purchase made on or via the site (hereinafter referred to as the "Transaction"). These GTC aim to define the conditions under which Products are marketed by æquidem. Their purpose is to determine the terms and conditions of sale, from site consultation to the payment process, as well as to define the rights and obligations of the parties in this context.
ACCEPTANCE AND MODIFICATION OF GTC
The client acknowledges having read, prior to placing an order, the general terms and conditions of sale set out on this screen, guarantees having full legal capacity to adhere to them, and agrees to respect them without reservation. This consent to the GTC is indicated by a checkbox in the form. æquidem reserves the right to modify its GTC at any time, without prior notice. In this case, the applicable conditions will be those in force on the date of the order by the buyer. It is therefore your responsibility to read and accept the GTC with each order you place on the site.
SITE OPERATION
The website is a secure online platform allowing the online purchase of items offered by the company æquidem (hereinafter referred to as the "Product(s)")
PRODUCTS
Characteristics: The description of the products is that published on the www.aequidem.fr website on the order date. Each product is presented on the website with a description summarizing its main technical characteristics (composition, main measurements, colors, price). Product images on the site are as accurate as possible but are provided for informational purposes only and in no way constitute a contractual representation of the product characteristics, particularly regarding appearance, general color, or any other characteristic.
The sale of products presented on the www.aequidem.fr website is intended for all buyers residing in countries that fully authorize the entry of these products into their territory. The buyer agrees to receive an invitation to give feedback on purchased products a few days after placing an order.
Availability: The products offered are those listed on the company's www.aequidem.fr website, within the limits of available stock. The company æquidem reserves the right to modify the product assortment at any time.
Each product sheet indicates: Either the product's stock availability: the "in stock" indication corresponds to the stock status at æquidem at the time of the order. Or a lead time: the lead time corresponds to the stock replenishment time at æquidem. This lead time is communicated by the supplier and/or manufacturer and varies depending on the type of product. Or the mention "Coming soon": the product is temporarily unavailable.
The publication of product descriptions on the site constitutes only an invitation to make an offer. By placing an order, the user makes an offer to æquidem, which has the right but not the obligation to accept or reject it, at its sole discretion and particularly depending on the availability of the ordered product.
Please note that æquidem cannot be held responsible for the unavailability of a product until the order has been accepted. The unavailability of the Product may be notified to the User:
• When entering their order, they will be informed that the desired product is temporarily unavailable
• After validating their order by email sent to the Buyer by æquidem.
In the event that payment has already been made, æquidem undertakes to contact the payment service to deduct the price of the unavailable Product(s) from the amount debited from the Buyer's bank account.
Price: The price of the products is indicated in euros (€) including all taxes. You acknowledge and accept that the products may be subject to customs duties, postal services, tax services, or any additional costs related to the transport, import, or delivery of products. These taxes are beyond æquidem's control. You undertake, if applicable, to bear these additional costs in full when you click the "VALIDATE" button and accept the GTC by doing so.
æquidem reserves the right to modify the price of its products at any time; however, the prices invoiced are those displayed on the site at the time of the order and cannot be changed once the order has been placed.
Order: Your order is subject to the stock availability of the ordered product(s). The products selected in your cart are reserved electronically for a limited time when you click the "VALIDATE" button. This electronic reservation is, however, subject to confirmation by the æquidem team for setting aside the product(s).
The company cannot be held responsible in case of a product not being available at the time of order. In such a case, the company will cancel the order, and your payment will be cancelled and re-credited. To confirm the consumer's intent, æquidem undertakes to confirm every order by email to the email address provided by the client. This confirmation will include the ordered item, its price, payment method, and delivery terms.
By placing an order, you guarantee that you will use the product for personal use only, and not for resale. æquidem, at its sole discretion, reserves the right not to confirm and fulfill an order, including but not limited to, orders that do not appear to be made in good faith, especially due to abnormal quantities ordered, repeated payment incidents with the same client, or an incomplete or abnormal delivery address, etc. æquidem will inform the client of its decision by any appropriate means.
To place an order on the site, you must complete the form and follow the site's instructions, including reading and then accepting the GTC. By completing the form, you must specify the payment method that will be used to complete the transaction in response to your order, subject to acceptance by æquidem.
For each order, the name, billing address, delivery address, and payment method used are verified. The following payment methods are accepted by æquidem: Visa, American Express, Master Card. Only personal payment cards (excluding professional cards) whose individual holder resides at the billing address are accepted. The billing information declared during your order must correspond to the holder of the payment card used, whom æquidem must be able to contact directly if necessary, to request additional information.
The additional verifications mentioned above may result in an additional delay of five (5) working days to be added to the delivery time. In the event that this condition is not met and/or æquidem is unable to reach the cardholder, æquidem reserves the right to cancel your order. The sale will be concluded upon æquidem's validation of the order payment, i.e., the payment validation date for orders paid online by credit card, or the date of receipt of payment by bank transfer.
If you prefer to place your order through Customer Service, æquidem invites you to contact them under the conditions mentioned in Article 1 of these GTC. Please note that no bank details should be sent by email or through the contact form to customer service. The person in charge of your order at customer service will request – by phone or email – the information required by banking institutions to allow payment for your order. Your payment card will only be debited at the time of shipment of your order, after verification of your data, upon receipt of the authorization provided by your bank and after acceptance of your order by æquidem.
Subject to acceptance of your order, æquidem will send you a confirmation of the transaction's conclusion to the email address you provided during the order. The transaction will only be deemed concluded when æquidem has confirmed its acceptance by sending you the confirmation email, including an order summary, product prices, order date and time, shipping costs, your chosen payment method, and the product's selling price will be collected.
It is specified that any order placed on a public holiday or weekend will be processed on the next business day. If you wish to cancel or modify your order before the ordered products are shipped, you can contact æquidem within 24 hours at the following address: aequidem@gmail.com. æquidem will make its best efforts to respond favorably to your request but cannot guarantee that the order will be canceled or modified.
GIFT CARD
The gift card is valid for one year from the date of purchase. You have a 14-day withdrawal period after purchase; after this period, the gift card cannot be refunded. The æquidem gift card can only be used once, and any unspent amount cannot be refunded or used for a second purchase. If your order amount exceeds the value of your gift card, you will need to pay the remainder with another payment method. If you return a product purchased with our gift card, the amount of this product will be refunded to you.
Our gift cards are nominative and are not transferable to a third party. They cannot be returned or exchanged for cash or other payment methods. æquidem is not responsible for sending a virtual gift card to an incorrect or non-existent email address. In this case, only the buyer is responsible. æquidem is not responsible for theft, loss, destruction, or unauthorized use of a gift card. æquidem reserves the right to cancel an order in case of suspected fraud or abusive behavior. Shipping costs are free for printed gift cards.
TRANSPORT AND DELIVERY
Deliveries are made to the address indicated by the Client in the form at the time of order, or to the Post Office on which the delivery address mentioned by the Buyer depends, in case of absence of the recipient of the Products. In the latter case, the postman will leave a delivery notice in the recipient's mailbox allowing them to collect their package during the Post Office's opening hours, within a period of fifteen (15) days. The delivery address must not be a post office box. The information stated by the Buyer when placing the order is binding on them. In case of an error in the recipient's contact details, æquidem cannot be held responsible for the impossibility of delivering the Product. Order deliveries are carried out by independent service providers of the company æquidem and within the deadlines announced by these providers.
The deadlines announced by these service providers vary depending on geographical areas. The deadlines indicated on the site by æquidem are indicative deadlines, corresponding to average processing and delivery times. æquidem will not be responsible for delivery delays due to the carrier, damage due to transport, or any other damage, directly or indirectly related to the transport of products. æquidem undertakes to make its best efforts to ensure that the order is executed within a maximum of 3 to 7 days from the day following the validation of the order, except in cases of force majeure referred to in Article 11. Shipping costs are calculated based on the weight of the package and the destination, according to the rates in force by postal services. For all deliveries in France, shipping costs are free for purchases of 80€ incl. VAT or more on the æquidem website. For deliveries in France for orders under 80€ incl. VAT, and for all deliveries outside mainland France regardless of the purchase amount, shipping costs are due.
Any re-shipment due to an incorrect delivery address or non-collection from Postal Services will result in the payment of additional charges, after acceptance by the Buyer. In the event of the Buyer's refusal to pay these additional re-shipment charges, the order will be canceled and the order price will be refunded to the Buyer's account, minus the shipping costs incurred. On the day of receipt of the products, you must immediately check that the packaging of your package is intact and has not been altered in any way whatsoever. If the packaging is damaged, æquidem advises you to take detailed pictures of the package and products upon receipt, to immediately make a declaration to the carrier in charge of delivery upon delivery of the products, and to inform our Customer Service within three working days. In case of a claim made under the conditions mentioned in the previous paragraph, to the carrier and/or our Customer Service, an investigation will be opened with the carrier and a response will be sent to you as soon as possible. In the absence of such an express claim, the delivery will be considered accepted and no dispute regarding the packaging can be validly made thereafter.
WITHDRAWAL
Return: In accordance with the provisions of articles L.121-20 and following of the Consumer Code, you have a period of fourteen working days from the delivery of your order to exercise your right of withdrawal, and thus return the product in its original packaging for exchange or refund without penalty, with the exception of return costs which are at your expense. A confirmation email will be sent to you upon receipt and verification of the returned product.
Return Policy: Before returning the product, you must contact Customer Service at aequidem@gmail.com
Returns will only be accepted if the product has not been unpacked/used. Protective covers, cards, and labels must also be returned. æquidem does not accept returns of products that appear to have been used or have been damaged. Any return must be preceded by the assignment of a withdrawal number obtained from æquidem and returned to the following address: æquidem, 5 rue de la paix, 92 270 BOIS COLOMBES. Failing this, the package will be refused.
The refund will be issued within 30 days following the date on which the client exercised their right of withdrawal (Article L121-20-1 of the Consumer Code).
HOW TO RETURN YOUR ACCESSORIES?
1) Preparing your package: Ensure that the returned item(s) are in their original condition. Carefully place them in their packaging, accompanied by the return slip to print and complete (reason for return and order number). Stick the return label on the shipping box and send it directly to a post office. You undertake to take particular care in packaging the product you return. If the returned product has been damaged due to incorrect packaging, æquidem reserves the right to refuse this return.
2) Return: to be sent to the following address: æquidem 5 rue de la Paix 92270 Bois-Colombes France.
3) Proof of deposit: We recommend keeping all proof of deposit in case of dispute or loss of your package by the carrier. After receiving the returned products from you, and provided that the return conditions are met, æquidem will process your request and notify you by e-mail that the refund of your order amount is being processed. A refund will then be made in the same manner as the initial payment. The refund may take up to 30 (thirty) business days following the confirmation by email sent by æquidem.

Warranty: All products supplied by æquidem benefit from the legal warranty provided by articles 1641 and following of the Civil Code. In case of non-conformity of a sold product, it may be returned to the company, which will take it back, exchange it, or refund it. If your product has a defect, please report it to Customer Service immediately, and no later than five (5) days following the delivery date, at aequidem@gmail.com. In such a case, you must indicate the alleged defect in your email and attach all supporting documents for your request (detailed photos of the product, purchase date, order number, etc.).
After examining these elements, æquidem reserves the right to retrieve the Product for physical expertise. Only in the case of a recognized defect, æquidem undertakes either to replace the defective Product within the limits of available stock, or to partially or fully refund its purchase price, depending on the nature of the defect. æquidem reserves the right to refuse to act on a late claim, or a claim relating to a defect for which you are responsible. All claims, exchange requests, or refund requests must be made by email to aequidem@gmail.com or by post to the following address: æquidem, 5 rue de la Paix 92270 Bois-Colombes.
FORCE MAJEURE
æquidem has a mere obligation of means for all stages of access to and ordering on the Site (ordering process, delivery, customer service, etc.). æquidem's liability cannot be invoked for any inconvenience or damage inherent in the use of the Internet, a service interruption, an external intrusion or the presence of computer viruses or any event deemed force majeure, in accordance with jurisprudence, including notably a postal service strike, stock shortage at the manufacturer, total destruction or loss of stock, cessation of production of a model of which æquidem had not been informed, and any other exceptional event.
LIMITATION OF LIABILITY
The information provided on the site, photographs, product sheets, prices, etc., are given for illustrative purposes. æquidem strives to ensure the accuracy of the information presented on the site. Any errors that may have been introduced are accidental and are corrected as quickly as possible. æquidem's liability cannot be invoked for simple errors or omissions that may have remained despite all precautions taken in the presentation of the products. The same applies to any product modifications decided by the manufacturers.
In accordance with current regulations, æquidem is not responsible for the non-performance or improper performance of the contract that would be attributable either to the consumer, or to the insurmountable and unforeseeable act of a third party to the contract, or to a case of force majeure. The Products offered comply with current French legislation. æquidem's liability cannot be invoked in the event of non-compliance with the legislation of the country where the Products are delivered. It is the Buyer's responsibility to check with local authorities the possibilities of importing or using the Products ordered.
Sole warranty granted: The Seller delivers Products in perfect condition upon handover to the carrier. In accordance with Article L 217-4 of the Consumer Code, the Seller is liable for any lack of conformity existing at the time of delivery. Any warranty is excluded in case of external damage or damage resulting from misuse, improper use, negligence or lack of maintenance, as well as in case of normal wear and tear of the Product.
Furthermore, the customer must inform the brand of any change in their contact details, more specifically any change of address, failing which the brand cannot be held responsible for delivering the package to an address that is no longer the customer's address. It is therefore the customer's responsibility to keep all their contact details up to date. In summary, æquidem's liability cannot be invoked as long as the damage caused is not proven to be a breach of the brand's obligations.
INTELLECTUAL PROPERTY
All intellectual property rights to the content of the Site (including texts, graphics, photos and other images, videos, sounds, trademarks and logos) as well as the products, are protected by copyright and trademark law. They are the exclusive property of æquidem. As such, and in accordance with the provisions of the Intellectual Property Code, only use for exclusively private purposes is authorised.
Any total or partial reproduction of the site and the products is strictly prohibited and engages the responsibility of its author. Any unauthorised exploitation of the site or any of its elements will be considered as an infringement and prosecuted in accordance with the provisions of Articles L.335-2 and following of the Intellectual Property Code. Any process, notably involving framing or deep-linking techniques, is formally prohibited, except with express, special, and written authorization issued by the Seller.
EXTERNAL LINKS
The Site may, from time to time, use external links that may include third-party offers and promotions. We provide these links to external sites solely to provide you with information, products and services that may be of interest or useful to you. We are in no way responsible for the content of these sites or the products and services they provide, and do not guarantee that they will be available indefinitely. The inclusion of these links does not imply any endorsement on our part of these associations and promoters.
COMMERCIAL OFFERS AND NEWSLETTERS
æquidem may send commercial offers to Customers by mail, email, SMS, telephone or via all web spaces managed by æquidem or any of its subsidiaries on social networks, subject to prior acceptance. The Customer has the right at any time to object free of charge to these commercial prospecting mailings, by clicking on the "unsubscribe" link in each email.
DATA PROTECTION
Within the framework of these GTC, the Seller is required to process the Customer's personal data. The data is processed for the following purposes:
- Order management and administration
- Preparation and dispatch of products
- Management of claims and the withdrawal process
In accordance with the provisions of Law No. 98-536 of July 1, 1998, transposing into the intellectual property code Directive 96/9/CE of March 11, 1996, concerning the legal protection of databases, æquidem is the producer and owner of all or part of the databases comprising this site.
By accessing this site, the client acknowledges that the data comprising it is legally protected, and, in accordance with the provisions of the aforementioned law of July 1, 1998, undertakes not to extract, reuse, store, reproduce, represent or retain, directly or indirectly, on any type of medium, by any means and in any form whatsoever, all or a qualitatively or quantitatively substantial part of the content of the databases appearing on the site to which they are accessing.
DISPUTE RESOLUTION
These distance selling conditions are subject to French law. For all disputes or litigation, æquidem and the client will do their utmost to find an amicable solution. If necessary, the competent Court will be that of the defendant's domicile in France.
APPLICABLE LAW
This contract and the GTC governing it are subject to French law. These GTC were updated on November 26, 2025.
